The Sandbox Club — Digital Millennium Copyright Act Notice & Takedown Policy

The Sandbox Club and its affiliated platforms, including Sandbox Social, respect the intellectual property rights of others and expect our members to do the same. This policy outlines our procedures for responding to claims of copyright infringement in accordance with the Digital Millennium Copyright Act of 1998 (DMCA), 17 U.S.C. § 512.

Reporting Copyright Infringement

If you believe that content hosted on our platform infringes your copyright, you may submit a written DMCA takedown notice to our designated agent. Your notice must include the following:

  • A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  • Identification of the copyrighted work claimed to have been infringed.
  • Identification of the material that is claimed to be infringing, including its location on our platform (URL or other specific description sufficient for us to locate it).
  • Your contact information, including name, address, telephone number, and email address.
  • A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

Please note that under Section 512(f) of the DMCA, any person who knowingly and materially misrepresents that material is infringing may be subject to liability for damages.

Response to Valid Notices

Upon receipt of a valid DMCA takedown notice, we will:

  • Promptly remove or disable access to the allegedly infringing material.
  • Notify the member who posted the content that it has been removed.
  • Provide the member with information on how to file a counter-notification if they believe the removal was in error.

Counter-Notification

If you believe your content was removed in error, you may submit a counter-notification to our DMCA Agent. Your counter-notification must include:

  • Your physical or electronic signature.
  • Identification of the material that was removed and the location where it appeared before removal.
  • A statement under penalty of perjury that you have a good faith belief the material was removed by mistake or misidentification.
  • Your name, address, and telephone number, and a statement consenting to the jurisdiction of the federal court in your district and that you will accept service of process from the person who provided the original DMCA notice.

Upon receipt of a valid counter-notification, we will forward it to the original complainant. If the complainant does not file a court action within 10 business days, we may restore the removed content.

Repeat Infringers

The Sandbox Club maintains a policy of terminating the accounts of members who are determined to be repeat infringers in appropriate circumstances. Repeat infringement may result in permanent suspension of membership and access to all club platforms.

User-Uploaded Content

The Sandbox Club does not pre-screen content uploaded by members. Members are solely responsible for ensuring they have the right to upload and share any content they post to our platforms. By uploading content, members represent and warrant that they own the content or have obtained all necessary permissions.
